The Ethics and Anti-Corruption Commission (EACC) in Kenya is tasked with preventing and combating corruption, economic crime, and unethical conduct in public office. The qualifications for appointing the Chairperson and other Commissioners of the EACC are set by the Constitution and the EACC Act of 2011.
Qualifications for Appointment of EACC Commissioners
(i) Chairperson
- Must meet the requirements of Chapter 6 of the Constitution.
- Must hold a degree from a university recognized in Kenya.
- Must have a minimum of 15 years of experience in fields such as ethics and governance, law, public administration, leadership, economics, social studies, audit, accounting, fraud investigation, public relations, or religious studies.
- Must have a distinguished career in their field.
(ii) Other Commissioners
- Must meet the requirements of Chapter 6 of the Constitution.
- Must hold a degree from a recognized university in Kenya.
- Must possess at least 15 years of experience in areas like ethics and governance, law, public administration, leadership, economics, social studies, audit, accounting, fraud investigation, public relations, media, religious studies, or philosophy.
Disqualifications
A person is not eligible for appointment as a Chairperson or Commissioner if they:
- Are a member of the governing body of a political party.
- Are an undischarged bankrupt.
- Have been convicted of a felony.
- Have been removed from public office for violating the Constitution or other laws.
Terms of Office
- The Chairperson and Commissioners serve a single term of 6 years and are not eligible for reappointment.
- They serve on a part-time basis.
