The suspension of a county government in Kenya can be initiated under two primary grounds:

  2. Exceptional Circumstances: Under exceptional circumstances not related to internal conflict or war, the President may suspend a county government if an independent commission of inquiry finds justified allegations against the county government, and the Senate authorizes the suspension.

Procedure for Suspension in Exceptional Circumstances

  1. Petition Submission: A petition requesting the suspension of a county government under exceptional circumstances must be supported by signatures from at least ten percent of the registered voters in the county.
  2. Presidential Report and Commission Nomination: Upon receiving the petition, the President submits a report on the allegations and grounds to the apex intergovernmental body. Subsequently, the President nominates a Commission to investigate the situation, comprising legal experts, law enforcement officials, and conflict management specialists.
  3. Commission Inquiry: The Commission conducts a thorough inquiry into the allegations within three months, providing affected county government officials with an opportunity to present their case.
  4. Report Submission: Based on the Commission’s findings, the President submits a report to the Speaker of the Senate, including the Commission’s recommendations and the petition for suspension.
  5. Senate Consideration: The Senate refers the matter to a relevant committee for examination. After considering the committee’s recommendations, the Senate votes on whether to authorize the suspension.
  6. Presidential Action: If the Senate authorizes the suspension, the President issues a notice in the Kenya Gazette suspending the county government for up to ninety days.

Implications of Suspension
