Nairobi, Kenya – February 19, 2025 The Kenya Kwanza government has introduced a new proposal that would mandate real-time GPS tracking for motorcycles used in public transport, commonly referred to as bodabodas. This measure is part of the Public Transport (Motorcycle Regulation) Act, 2023, currently under review in the National Assembly.
Mandatory Tracking for Public Transport Motorcycles
The proposed bill stipulates that all bodabodas must be fitted with a tracking security device approved by the county executive committee member. The purpose of this device is to facilitate real-time location monitoring, allowing authorities to track motorcycle movements at all times.
According to the bill:
“The security device referred to in sub-section (1) shall include a tracking device that allows for real-time monitoring of the location of the motorcycle.”
Once enacted, a database of approved motorcycle security devices will be established and maintained, ensuring compliance with the new law. The county executive committee member will also take charge of overseeing the management, regulation, and coordination of motorcycle transport within their respective jurisdictions.
Compliance and Responsibilities
The proposed law will require motorcycle owners and riders to:
- Ensure tracking devices are operational at all times.
- Notify county authorities immediately in case of device malfunctions or damage.
- Use only county-approved tracking devices.
Failure to comply with these provisions could lead to penalties or revocation of operating licenses for bodaboda operators.
Data Protection Concerns
Given the surveillance nature of this legislation, concerns about privacy and data security have been raised. However, the bill includes a clause referencing the Data Protection Act, stating:
“The collection, processing, and use of data obtained through the security device shall be subject to the provisions of the Data Protection Act.”
This means that while real-time tracking will be implemented, authorities are expected to adhere to Kenya’s data protection laws to prevent misuse of personal information.
Public Feedback Deadline
Kenyans have been given until Wednesday, March 5, 2024, to submit their comments and opinions on the proposed regulation before it moves to the next legislative phase.

Bodabodas play a crucial role in Kenya’s economy. A 2022 study by Car & General found that:
