Does Kenya Tax Foreign Income?
Yes. While Kenya operates a source-based tax system, resident individuals are taxed on their worldwide income, including income earned from foreign sources.
This means that:
- If you’re a Kenyan resident employed abroad, your foreign employment income must be declared and taxed in Kenya.
- If your business operates both in Kenya and abroad, income from both sources must be reported and taxed accordingly.
Who is Considered a Tax Resident?
A resident person in Kenya is any individual who meets one of the following criteria:
- Has a permanent home in Kenya
- Is present in Kenya for 183 days or more in a year
- Spends an average of 122 days per year over a three-year period
Once classified as a resident, you’re required to declare your foreign income along with local income and file a tax return via the iTax portal.
Filing and Payment Process
The tax return must be filed:
- On or before the last day of the 6th month after the end of your accounting period
- Through the iTax system, accessible worldwide with a KRA PIN and password
The portal offers self-service functions to enhance convenience, including return filing, tax payments, and access to certificates.
What About Double Taxation?
To avoid being taxed twice on the same income:
- Kenya allows tax relief through foreign tax credit: You may offset tax already paid abroad against the tax due in Kenya on the same income.
- If Kenya has a Double Tax Agreement (DTA) with the foreign country, the agreement will dictate which country has taxing rights.
DTAs are bilateral treaties that allocate taxation rights between two countries to prevent double taxation and tax evasion. In their absence, the risk of double taxation is higher.
