Ever filed your tax return and ended up with a negative figure on the computation sheet? If you’re employed, this might seem strange since your taxes are usually deducted and remitted by your employer. But don’t worry—that negative figure could mean you’re eligible for a tax refund.

What is a Tax Refund?

A tax refund is a reimbursement of excess tax paid or tax paid in error. It arises when your actual tax liability is less than the tax you already paid.

Common types of refunds include:

  • Excise Duty Refunds
  • Stamp Duty Refunds

When Does a Tax Refund Arise?

Income Tax Refunds:

These typically occur when:

  • An employer fails to apply tax relief for life or education insurance policies
  • A mortgage interest relief is not granted (only applicable to mortgages from institutions listed in the 4th Schedule of the Income Tax Act)
  • A personal relief is not granted during the year
  • Withholding tax deducted exceeds the actual tax liability

VAT Refunds:

VAT refunds may arise from:

  • Tax paid in error on a supply (must be claimed within 12 months)
  • Bad debt—if no payment is received 3 years after supplying goods or services
  • Excess input tax from zero-rated supplies
  • Overpayments or credits from Withholding VAT

⚠️ Claims for bad debts must be made within 5 years, or they become time-barred. If the tax is later recovered, the refunded amount must be repaid to KRA within 30 days of recovery.


How to Apply for a Tax Refund in Kenya

Tax refund applications are made via the iTax portal. The process is fully online.

Required Documents for Income Tax Refunds:

  • Form P9 (Tax Deduction Card) for excess PAYE claims
  • Insurance policy certificate for insurance relief claims
  • Mortgage certificate from a licensed financial institution
  • Withholding tax certificate for claims related to over-deductions

📌 Important: File your refund immediately after submitting your annual return for that year.

Refund Processing Timeline

Once a refund claim is submitted with all the correct documentation:

  • KRA processes the claim within 90 days
  • You’ll receive an approval or rejection order via email

Yes, KRA does process refunds—but only for claims that are fully supported and compliant with all requirements.
