In its corporate capacity, it is authorized to:
- Initiate or face legal actions.
- Acquire, hold, charge, or dispose of both movable and immovable property.
- Borrow funds or make investments.
- Enter into contractual agreements.
- Execute any other activities or tasks necessary for effectively carrying out its duties as mandated by the Kenya National Examinations Council Act, consistent with the legal capacities of a corporate body.
The Kenya National Examinations Council is composed of:
- A Chairperson, appointed by the President.
- The Principal Secretary of the Education Ministry or their representative.
- The Principal Secretary to the National Treasury or their representative.
- The officer overseeing quality assurance and standards in the Education Ministry.
- The Director of the Kenya Institute of Curriculum Development.
- The Secretary of the Teachers Service Commission.
- Three individuals appointed by the Cabinet Secretary for Education, representing:
- Persons with disabilities.
- Post-school technical and business training institutions, including polytechnics.
- The private sector involved in education management, as determined by the Cabinet Secretary.
- The Chief Executive Officer of the Council.
The Chairperson and appointed members serve a four-year term, with eligibility for one additional term. The Chief Executive Officer’s term is five years, with the possibility of one reappointment.

- Verifying the authenticity of certificates or diplomas it has issued, responding to requests from the government, public institutions, educational entities, employers, and other stakeholders.
- Reissuing certificates or diplomas upon receiving satisfactory evidence of the original’s loss.
- Conducting research on educational assessment.
- Offering advice on assessment systems development and use to any public institution that seeks its expertise, under mutually agreed terms and conditions.
- Working towards the international recognition of qualifications conferred by the Council.
- Providing recommendations to the government on policy decisions that affect the Council’s operations or examination administration in Kenya.
- Undertaking activities that facilitate or are related to its core functions.
The Kenya National Examinations Council (KNEC) has the authority to:
- Formulate rules governing the conduct of examinations and related matters.
- Establish regulations for confirming examination results and related procedures.
- Make rules for issuing replacement certificates or diplomas and associated processes.
- Develop regulations for the issuance of certificates or diplomas.
- Withhold or annul the results of candidates implicated in examination irregularities or malpractice.
- Designate education or training officers, including institution heads, to aid in exam administration as determined by the Council in agreement with the Cabinet Secretary for Education.
- Equate certificates from accredited foreign examining bodies with the Council’s qualifications.
- Administer exams on behalf of foreign states or entities upon their request.
- Conduct academic, technical, and other exams outside Kenya when requested.
- Provide examination and advisory services to private institutions in Kenya upon request, under terms set by the Council.
- Engage bodies within or outside Kenya to conduct academic, technical, and other national exams on its behalf or in collaboration, and to issue certificates or diplomas to successful candidates.
- Work with these bodies to fulfill its functions.
- Advise on adapting exams to suit Kenyan requirements and support such bodies in conducting these exams.
- Ensure its regulations on personal data collection and processing comply with the Data Protection Act.
The Kenya National Examinations Council (KNEC) possesses comprehensive powers to effectively execute its duties, including the ability to:
- Collaborate or form associations with other entities or organizations, both within and outside Kenya, as deemed beneficial or suitable to advance the objectives for which the Council was established.
- Provide services to individuals, institutions, or foreign governments based on terms periodically set by the Council.
- Engage in any activities deemed necessary to achieve its functions and objectives.
