Former Chief Justice David Maraga has opened up about the tense and frightening hours that followed the Supreme Court’s historic decision to annul Uhuru Kenyatta’s presidential victory in 2017. Speaking in a recent interview, the former CJ revealed that the ruling thrust him into a storm of political anger and public hostility that left his family shaken and forced him to confront the price of defending constitutional order.

A Historic Decision With Personal Consequences
Maraga explained that the Supreme Court reached its verdict only after a detailed review of the presidential petition, emphasising that the judges acted based on evidence and their constitutional mandate. But even as the ruling made global headlines for its boldness, it set off a wave of resentment that quickly became personal. He said the backlash unfolded immediately, with anger directed not just at the institution but at him as the face of the judiciary’s defiance of executive power.

Public Rage and a Family in Fear
In the interview, Maraga recalled the moment President Uhuru Kenyatta expressed his displeasure with the court and promised to “revisit” the decision. According to him, that single statement heightened anxiety within his household, and the atmosphere changed overnight. Messages of abuse, accusations of bias, and warnings of possible attacks flooded in from the public. Even though no physical attempt was made on his life, the fear within his home was real. His family struggled to cope with the hostility and the unpredictability of what might follow.

How the Court Reached Its Decision
Looking back at the events, Maraga said the decision to invalidate the presidential election was grounded in irregularities that, in the judges’ view, compromised the integrity of the poll. Four judges agreed that the process had not met constitutional standards, particularly in the transmission of results and adherence to electoral procedure. Their ruling nullified the outcome and ordered a fresh election within sixty days, marking the first time an African court had overturned a presidential contest on procedural grounds.

The period following the judgment was marked by political confrontation and rising tension across the country. While Uhuru publicly stated he respected the ruling, he also accused the judges of subverting the will of millions of voters. His comments fueled public anger that spilled into rallies, commentary, and social media, often centering on Maraga. Government allies questioned the motives behind the ruling, while opposition leader Raila Odinga hailed the decision as proof that the electoral process had failed to guarantee fairness. The result was a deeply polarised national environment in which the judiciary found itself under sustained attack.
