Background of the Case

On May 20, 2025, Governor George Natembeya appeared before the Milimani Anti-Corruption Court in Nairobi, facing three counts: two of conflict of interest and one of unlawful acquisition of public property. The charges stem from alleged procurement irregularities and financial misconduct involving over KSh 3.2 million in county funds between January 2023 and April 2025.

Detailed Charges

Count 1: Conflict of Interest

Natembeya is accused of receiving KSh 1,127,900 from Mercy Chelangat, director of Lyma Agro Science Limited and proprietor of Maira Stores, both of which secured contracts with the Trans Nzoia County Government.

Count 2: Conflict of Interest

The governor allegedly received KSh 2,124,668 from Emmanuel Wafula Masungo, the beneficial owner of Easterly Winds Limited, another company that conducted business with the county government.

Count 3: Unlawful Acquisition of Public Property

Natembeya is charged with unlawfully acquiring KSh 3,252,568 in public funds, purportedly part of payments made by the county to Chelangat’s firm.

Court Proceedings and Bail Conditions

During the court session, Natembeya pleaded not guilty to all charges. The prosecution opposed his release on bail, citing concerns over potential interference with witnesses and ongoing investigations.

However, Principal Magistrate Charles Ondieki granted the governor a bond of KSh 1 million or an alternative cash bail of KSh 500,000. The court imposed several conditions:

  • Natembeya is barred from accessing his office for 60 days.
  • He is prohibited from leaving the country without court permission.
  • The governor must refrain from discussing the case publicly or through the media.
  • Any breach of these conditions could lead to the cancellation of his bail.

Political Reactions and Implications

The case has elicited varied reactions across the political spectrum. Supporters of Natembeya, including prominent political figures like DAP-K party leader Eugene Wamalwa and Roots Party leader George Wajackoyah, have decried the charges as politically motivated. They argue that the governor’s vocal criticism of the national government has made him a target for political retribution.

Conversely, proponents of the anti-corruption campaign view the charges as a testament to the government’s commitment to accountability and transparency, regardless of political affiliations.

Next Steps in the Legal Process

The court has scheduled a pre-trial conference for June 3, 2025. The prosecution is expected to furnish all documentary evidence to the defense by this date. The outcome of this case could have significant ramifications for Natembeya’s political career and the broader discourse on governance and corruption in Kenya.

Conclusion

Governor George Natembeya’s corruption case underscores the complexities of governance, accountability, and political dynamics in Kenya. As the legal proceedings unfold, the nation watches closely, recognizing that the case’s outcome could set a precedent for how corruption allegations against high-ranking officials are handled in the future.
