A constitution is the foundation for building an organisation. How to Amendment a Non-Governmental Organization Constitution in Kenya. It should contain all the key agreements made by members on how the organisation will work. In law it is called the “founding document” and it is legally binding on the executive and members of the organisation.

A non-governmental organization (NGO) or non-governmental organisation (see spelling differences) is an organization that generally is formed independent from government. They are typically nonprofit entities, and many of them are active in humanitarianism or the social sciences; they can also include clubs and associations that provide services to their members and others. Surveys indicate that NGOs have a high degree of public trust, which can make them a useful proxy for the concerns of society and stakeholders. However, NGOs can also be lobby groups for corporations, such as the World Economic Forum.[8][9][10][11] NGOs are distinguished from international and intergovernmental organizations (IOs) in that the latter are more directly involved with sovereign states and their governments.

Here is How to Amendment a Non-Governmental Organization Constitution in Kenya

  • A non-governmental organization (NGO) is a non-profit, voluntary citizens’ group that is organized on a local, national or international level.
  • All NGO’s must be registered by NGO Coordination Board in accordance with the NGO coordination Act.

Apply In-Person

ADVERTISEMENT
  1. The Board of directors of a NGO should carry out a meeting and take minutes on having a amendment’s to the constitution.
  2. This is followed by amending of the NGO’s constitution.
  3. Once the new constitution is ready and a formal application addressed to the Executive Director seeking for consent, signed by the five registered officials of the Organization should be made.
  4. The application should be submitted to the Non-Governmental Organizations Co-ordination Board offices together with the required documents.(i) Minutes of the meeting proposing amendment .
    • The minutes should be submitted within 14 days from the date of meeting.
    • The minutes should indicate the reasons for having the amendment.
    (ii) Amended copy of the constitution with highlighted sections to be amended
  5. You should then proceed to pay the processing fees and summit the receipt to the Non-Governmental Organizations Co-ordination Board offices. A Processing fee of Kes.4,000/= is charged for the request.
    Payments by Cheque or cash should be made to:
    NGO’s co-Ordination Board Account no: 01136030582102
    Co-operative bank
    Co-op house branch
  6. On Completion of this process, it will take Non-Governmental Organizations Co-ordination Board two days to acknowledge the amendments and affect them within 90 days.

Required Documents

  1. Formal application addressed to the Executive Director seeking for consent, signed by the five (5) registered officials of the Organization.
  2. Copy of the Minute of the meeting authorizing the amendments to the Constitution to be submitted within 14 days of the meeting clearly giving reasons for the amendment.
  3. Copy of the new Constitution with highlighted sections to be amended.
  4. Registered Non-governmental organisations in Kenya are eligible to make an amendment of their constitution.
  5. A processing fee of Kes.4,000/= is charged
  6. The validity of the constitution is forever.
  7. The application is done by writing the request letter to the Executive Director of the Non-Governmental Organization Board.
  8. On Completion of this process, it will take Non-Governmental Organizations Co-ordination Board two days to acknowledge the change the name and changes are effected within 90 days

  7. The Non-Governmental Organizations Co-ordination Board is a State Corporation established by the Non-Governmental Organizations Co-ordination Act (Cap 19) of 1990. The Board has the responsibility of regulating and enabling the NGO sector in Kenya.
  8. The Board is currently under the Ministry of Interior and Coordination of National Government.
  9. All NGO applications should be typed or filled in block letters.
  10. All applications MUST contain ORIGINAL signatures of the officials and members as applicable.
  11. All signatures must be originals, scanned copies will not be accepted
